Who Needs Workers’ Compensation in Florida?
Workers’ compensation requirements in Florida depend on industry, business size, and workforce type. Key guidelines include:

Construction Businesses: Coverage required with at least one employee, including corporate officers and LLC members.
Non-Construction Businesses: Coverage required for businesses with four or more employees, including corporate officers or LLC members.
Agricultural Businesses: Coverage required if the business has six or more regular employees or 12 or more seasonal employees working over 30 days in a season (up to 45 days annually).
Out-of-State Employers: Coverage must comply with Florida law for any employees working within the state.
Contractors: Must confirm that independent contractors and subcontractors have proper workers’ compensation coverage before starting work.

Florida Workers’ Compensation Exemptions

Sole Proprietors & Partnerships: May file for an exemption but can still opt to purchase coverage if desired.
